What Must Be Done – A Summary

• To proactively eliminate the incentives to illegally migrate to the US, we should…
  • Deport illegal aliens who have not committed felonies[1] in the US, and who…
    • Are caught coming into the US without requesting asylum.
    • Are here because they have overstayed their visas or escaped capture for an extended period of time, regardless of what their native countries are[2] or under what programs they came to the US. We must ensure that our solutions to illegal alien problems don’t discriminate against Latinos.

• • Send Latin American asylum seekers back to await their asylum hearings in Latin America in their home countries or the first country there that is absent the conflict from which they are fleeing.  This includes asylum seekers who came through Latin America from other parts of the world, such as Africa, Asia, and the Middle East.
    • Have Latin American asylum seekers participate in their asylum hearings at US embassies  in those Latin American countries (often via teleconference with DOJ immigration judges located in the US).
      
    • Motivate legitimate Latin American asylum seekers to seek asylum in Latin America in the first country absent the conflict from which they are fleeing. President Trump is reportedly negotiating a Safe Third Country Agreement[3] with Guatemala.  We should also negotiate such an agreement with Mexico.    Guatemala and Mexico are that first country for many of those in the current, unprecedented tsunami of illegal aliens who are primarily from Latin America.
• Make illegal aliens such an unreliable source of labor for US employers that they will voluntarily prefer US citizens as employees, even if they must pay them a higher, fairer wage.
  • This will complement President Trump’s Second Chance For Success initiative, which helps give US citizens who are leaving prison a second chance to be hired, contributing to their opportunities to succeed.
• Vigorously attack identity fraud by illegal aliens and asylum seekers using fraudulent IDs to get jobs.
  • Cross-check multiple government databases much more rigorously.
  • Immediately deport illegal aliens and asylum seekers who use fraudulent IDs to get jobs and other benefits.

Primary Benefits

Implementing this change in strategy will…

• Be a huge win for our most economically vulnerable US citizens
  • Who compete for jobs against unskilled illegal aliens and
  • Whose wages are driven down by job competition with those aliens.
• Be a monumental relief for our communities that have been burdened by the costs imposed by illegal aliens: healthcare, education, housing, legal and other costs.  Reductions in these costs would more than offset the cost of this approach.  That these aliens are here illegally is secondarily important, compared with the fact that most are unskilled and poorly educated with limited English proficiency.  Most of these costs to our communities, states and country and the problems that these aliens impose on our most vulnerable citizens will not be solved by changing our immigration laws to make these aliens legal.
• Allow the Border Patrol and ICE[4] to refocus personnel and other resources on their primary missions such as stopping illegal drugs, human trafficking, and other violent criminal activity, instead of on rounding up the huge numbers of economic migrants that currently overwhelm them.

Key Root Causes

Some of the key root causes of our illegal alien crisis are that:

• The vast majority of illegal aliens who are from or come through Latin America are just economic migrants, who are looking for better jobs and the affluence of the United States, but who don’t meet our legal standards for asylum. But they know that if they request asylum…
  • They cannot be deported without an immigration court hearing, which takes many months, and
  • Their chances of being released into the US economy while they wait for those hearings and never being caught are very high, especially if they are accompanied by children.
• Reportedly, about 87% of Latin American asylum seekers who are released into our economy are no-shows for their immigration hearings. And about 75% of those who do show up are denied asylum.  This means that only about 3% of those who request asylum qualify for it.
• US Justice Department does not prosecute aggressively enough US employers when they knowingly hire illegal aliens or those who aid and abet illegal aliens in their procurement of false identification documents.

Other Existing Key Elements Of The Solution

• The US 9^th Circuit Court ruled on May 7^th that the Trump Administration can send Latin American asylum seekers back to Mexico pending their asylum hearings.  So far, the Trump Administration has only returned a very small number and has sent them just a short distance back south across the border.  That’s causing a humanitarian crisis in northern Mexico.
• Mexico may (or may not) do much more to slow illegal migration from Latin America under its agreement with President Trump that he announced on June 7^th.  Also, the Mexican drug and human trafficking cartels exert tremendous influence within Mexico’s government, from high level officials all the way down to at least some of the individual soldiers who will be enforcing that agreement with President Trump.  Mexico will probably, at least to some extent, make the minimum effort required to avoid economic sanctions.  That’s not good enough.

[1] Those who do commit felonies should be sent to prison.

[2] This includes more than one million illegal aliens who currently have legally binding deportation/removal orders against them.

[3] Safe Third Country Agreements, such as the one the United States has with Canada, require that persons seeking refugee protection must make a claim in the first country they arrive in unless they qualify for an exception to the Agreement.
